MINUTE ORDER issued by Courtroom Deputy for District Judge Daniel J. Calabretta on 11/4/2026: This case has been initiated by the same Petitioner who initiated a prior action, Case No. 1:26-cv-07530-JLT-SAB (HC), related to Petitioner's present immigration custody status. Pursuant to Local Rule 123, the Court finds that this action is related to the prior action because both cases involve overlapping parties, properties, claims, events and/or questions of fact or law. Accordingly, assignment of the actions to the same District Judge and Magistrate Judge who were assigned to the consolidated action will promote convenience, efficiency, and economy for the Court and parties. Thus, the Court ORDERS that this case is reassigned to District Judge Jennifer L. Thurston and Magistrate Judge Stanley A. Boone. All future filings shall use the following Case Number: 1:26-cv-09032-JLT-SAB (HC). (cc: DJC, SCR) [TEXT ONLY ENTRY] (Deputy Clerk GJM) (Entered: 11/04/2026)

MINUTE ORDER signed by District Judge Jennifer L. Thurston on 11/5/2026: The Court has reviewed the petition filed under 28 U.S.C. § 2241 (Doc. 1 ) and the related request for emergency injunctive relief (Doc. 2 ). Petitioner challenges his "detention without a custody hearing" and asserts that he suffered a due process violation because he was entitled to a hearing prior to his detention. (Doc. 1 at 3, id. at 3-5.) The Court finds these claim and issues raised were previously raised in the first petition, which also included a due process claim and challenged Petitioner's "detention without a custody hearing." (Case No. 1:26-cv-07530-JLT-SAB, Doc. 1 at 6-7.) For this reason, the Court finds this second action is duplicative. Accordingly, the current case (1:26-cv-09032) is DISMISSED. The Clerk of Court is directed to terminate pending matters, including the motion for a temporary restraining order (Doc. 2 ) as MOOT and close this case.
