ORDER. The Court is in receipt of Petitioners' motion for a temporary restraining order. The Court ORDERS Petitioners to serve the motion on Respondents by email by 9:00 p.m. today, November 4, 2026. To preserve the status quo, the Court ORDERS Respondents to not remove or transfer Petitioners from this District until further order of this Court. The Court requires additional information to evaluate Petitioners' claims. Respondents shall file a response to the motion by November 5, 2026, at 1:00 p.m. Respondents SHALL include in their response: the Petitioners' full Form I-213, any orders of release or detention, any custody warrants or notices, any indications of past criminal history, and any other portions of Petitioners' A-File relevant to the determination of the issues presented in the Petition. Failure to timely respond shall be construed as a non-opposition. Petitioners shall file a reply by November 6, 2026, at 9:00 a.m. The Court will set a hearing only if needed. Additionally, the Court notes that judges in this District and others have recently evaluated the merits of habeas petitions simultaneous to requests for preliminary injunctive relief. The parties shall include in their supplemental brief a statement as to why, or why not, the Court should consider the preliminary injunction and habeas petition at the same time. See Fed. R. Civ. P. 65(a)(2) (before or after beginning the hearing on a motion for a preliminary injunction, the court may advance the trial on the merits and consolidate it with the hearing); see also 28 U.S.C. § 2243 ("The court shall summarily hear and determine the facts, and dispose of [a petitioner's habeas petition] as law and justice require.").
