Nov 02, 2026
TEXT ORDER - The Court has reviewed the Petition for Writ of Habeas Corpus pursuant to 28 U.S.C. § 2241 ("Petition") of Petitioner, Milton Jose David Romero ("Petitioner"), who is currently detained at Elizabeth Contract Detention Center in Elizabeth, New Jersey. (ECF No. 1.) According to the Petition, Petitioner is a citizen of the Dominican Republic who entered the United States on a tourist visa in May 2025 and subsequently married a U.S. citizen, who filed an I-130 petition on his behalf. After learning during a USCIS interview that he faced criminal charges in New Jersey, Petitioner surrendered to state authorities. Following his release from state custody, he was taken into immigration custody. Petitioner asserts that he suffers from diabetes and is experiencing elevated blood sugar while detained. Petitioner contends that his continued detention violates the Immigration and Nationality Act and the Due Process Clause of the Fifth Amendment. (Id.) Accordingly, it is ORDERED that Respondents shall show cause in writing within seven (7) days why the Petition (ECF No. 1) should not be granted. Petitioner may file a reply within three (3) days of Respondents' submission. It is further ORDERED that the parties shall meet and confer regarding Petitioner's reported elevated blood sugar and the adequacy of his medical care while detained, and shall notify the Court of the results of their conference within three (3) days of the entry of this Order. Petitioner shall not be transferred from New Jersey during the pendency of these proceedings. So Ordered by Judge Karen M. Williams on November 2, 2026. (Williams, Karen) (Entered: 11/02/2026)
