ORDER denying 2 Motion for Temporary Restraining Order. "DHS is free to remove [a noncitizen with an administratively final removal order] unless a court issues a stay." Johnson v. Guzman Chavez, 594 U.S. 523, 534 (2021). Nevertheless, the 5 Scheduling Order largely moots Petitioner's requests to enjoin Respondents from removing or transferring her during the pendency of this action. Should Respondents indicate an intent to imminently transfer Petitioner, Petitioner may move for emergency relief as needed. For the avoidance of doubt, the Court clarifies that Respondents shall not remove or transfer Petitioner without providing the required advance notice and filing such notice on the docket.
