TEXT ORDER finding as moot (9) Motion to Enforce Judgment in case 1:26-cv-00113-JJM-AEM: Before the Court is Petitioner Ying Liang Deng's Petition of Wirt of Habeas Corpus, ECF No. 1 (CA26-810JJM), and, relatedly, a Motion to Enforce his former habeas petition where this Court granted his release under OSUP conditions pending his removal. Deng v. Nessinger, No. 1:26-cv-00113-JJM-AEM, ECF No. 7. Consistent with the regulatory framework under 8 C.F.R. §241.13(i)(2), the Court cannot conclude that Mr. Deng's removal will happen in the "reasonable foreseeable future." See Kong v. United States, 62 F.4th 608, 61920 (1st Cir. 2023). Moreover, in trying to distinguish the Court's holding in Vittini-Arias, Respondents fail to see one salient detail similar in that case: the absence of a flight manifest or other travel records supporting the removal proceeding. Without production of documents indicating a "changed circumstance" other than what was previously provided in the scheduled October 23, 2026 removal date, the alleged imminence Respondents allude to says nothing about the reasonable foreseeability of future removal by November 9, 2026. Respondents have twice failed to materialize Mr. Deng's removal; the Court is not willing to jeopardize a third without production that substantiates a true changed circumstance. For the above reasons, the Court ORDERS Respondents to provide a showing of travel arrangements such as a flight manifest or other related travel documents WITHIN 24 HOURS of this order. If no travel document is produced, the Court ORDERS Respondents to thereafter immediately release Mr. Deng, restoring his former OSUP status. In the meantime, Mr. Deng's Motion to Enforce in the concurrent case (CA26-113JJM, ECF No. 7) is moot and his present habeas petition (CA26-810JJM, ECF No. 1) is stayed pending Respondent's production of a flight manifest or travel documents. So Ordered by Chief Judge John J. McConnell, Jr. on 11/3/2026. (Jackson, Ryan)
