TEXT ORDER: The Court has reviewed the 1 Petition filed by Juan Carlos Conde Lopez under 28 U.S.C. § 2241 seeking an emergency writ of habeas corpus directing Petitioner's immediate release from immigration detention, or, in the alternative, a bond hearing. It is ORDERED: (1) that because Petitioner, who is proceeding pro se, is being detained by Immigration and Customs Enforcement, the Clerk is respectfully directed to add Todd Blanche, Attorney General of the United States as a respondent; (2) that Respondents are enjoined from moving Petitioner outside the jurisdiction of the Northern District of New York until further order; (3) that Respondents file a response to the Petition by Monday, 11/2/2026, and that any response include updated information regarding Petitioner's location and the status of any removal proceedings; and (4) that Petitioner shall file a reply by Friday, 11/6/2026. The Court will determine whether a hearing is required after reviewing the parties' briefs. The Clerk is respectfully directed to serve copies of this Text Order and the Petition upon the United States Attorney for the Northern District of New York in accordance with the Local Rules and to send copies of this Text Order to Petitioner at Montgomery County Correctional Facility and to the address on the envelope in which the Petition was sent.
