MINUTE entry before the Honorable April M. Perry: For the reasons that follow, Petitioner's motion for a writ of habeas corpus 1 is dismissed for lack of jurisdiction. In Case No. 26-cv-4179, the Court previously granted Petitioner a writ of habeas corpus due to the government's erroneous invocation of 8 U.S.C. § 1225(b)(2)(A) when detaining Petitioner. The writ ordered that the immigration judge hold a bond hearing in accordance with 8 U.S.C. § 1226. Petitioner concedes that he received at least two bond hearings thereafter. See Doc. 1 at 9; Doc. 5 at 1. Thus, this Court's previous order has been followed. Petitioner's new filing challenges the merits of his bond hearings. However, any further challenges to Petitioner's custody must be raised in a habeas corpus petition filed in the Judicial District of Petitioner's confinement. See Trump v. J.G.G., 604 U.S. 670, 672 (2025) (holding that for habeas petitions, jurisdiction lies only in the district of confinement). Petitioner alleges that he is presently detained at the Miami Correctional Facility in Bunker Hill, Indiana. Bunker Hill, Indiana is located in Miami County, Indiana. The judicial district for that county is the United States District Court for the Northern District of Indiana, South Bend Division. See 28 U.S.C. § 94(a)(2). Therefore, Petitioner's new habeas corpus petition should have been filed in the Northern District of Indiana. The Court declines to transfer the present matter to the Northern District of Indiana under 28 U.S.C. § 1631 as it would not be in the interests of justice because Petitioner's challenge to the denial of bond would be barred by the jurisdiction stripping provision of 8 U.S.C. § 1226(e). Finally, as for the subsequent filings which allege that Petitioner is being denied medical care for a shoulder injury that he received in custody, see Doc. 4, that type of claim should be brought in a separate non-habeas lawsuit, after Petitioner has exhausted all administrative remedies. See Robinson v. Sherrod, 631 F.3d 839, 841 (7th Cir. 2011) (stating that it is the Seventh Circuit's "view that habeas corpus is not a permissible route for challenging prison conditions").
