ORDER by Judge Noël Wise on November 5, 2026. On November 4, 2026, the Court held a hearing on the order to show cause why a preliminary injunction should not issue. ECF No. 15. Per the stipulation of the parties, the Court MAINTAINS the terms of the Order Granting the TRO (ECF No. 5) until November 19, 2026, at 11:30 a.m., or until further order of this Court. In its responsive brief and during oral argument, the government asserted that it arrested Petitioner pursuant to a valid and legally supported and sufficient warrant premised on the government's revocation of Petitioner's order of supervision, and that Petitioner resisted arrest. ECF No. 13. But the government provided no declarations for any of the officers, including the officer who revoked Petitioner's order of supervision, the officer who prepared the warrant, or any of the officers who were involved in Petitioner's arrest, or the interim detention and proceeding that occurred before Petitioner was brought to the hospital for his injuries. The government also did not provide any body camera footage of the arrest (even though the documents the government did provide note that there is body camera footage from the arrest). As a result, the Court has no authenticated documents or evidence from which to assess the facts of this case, which is foundational to the Court evaluating Petitioner's claims. Therefore, as described during the hearing and as reiterated and clarified in this Order, this Court requires additional information to make factual findings, and ORDERS the following:1) The government shall file, by November 10, 2026, all October 17, 2026 camera footage (including body camera footage, video from vehicles, or footage taken from any other location) from the time Petitioner was pulled over, through his arrest, transport, any stops (including all time at 630 Sansome Street), until Petitioner was admitted to the hospital.2) The government shall file, by November 10, 2026, a list of every officer and government employee (including officers, supervisors, etc.) who was involved in revoking Petitioner's order of supervision; preparing and executing Petitioner's arrest warrant; and/or arresting and transporting Petitioner from the arrest scene to the hospital, including any interim stops and interactions that occurred at those stops (including at 630 Sansome Street).3) The Court continues the hearing on the preliminary injunction to November 18, 2026, at 9:00 a.m. The hearing will be held in person.4) All officers and government employees on the government's list (noted in bullet 2) shall appear in person at the November 18, 2026 hearing. As discussed at the November 4, 2026 hearing, at a minimum, that includes the following officers already identified in the government's filings: Manuel Starr, David Pham, Officer Pineda-Chaveza, Officer Velasteguiji, Officer Castellon, Officer Ramirez, Officer Williams, Officer Eng, Officer Johnson, and Officer Watamaniuk.
