TEXT ORDER: Before the Court is Mr. Haddad's Petition for Writ of Habeas Corpus asserting five claims for relief, all relating to the sufficiency of his July 14, 2026 Immigration Court custody redetermination hearing. ECF No. 1 . In sum, he argues that the Immigration Judge ("IJ") violated his rights to due process by applying the wrong standard, not providing a reasoned decision, and not considering alternatives to detention. Id. Respondents disagree, arguing that the IJ considered all the evidence, found Mr. Haddad to be a danger by clear and convincing evidence, and considered and rejected alternatives to detention. ECF No. 6 . After considering the parties' arguments and reviewing the Respondents' Exhibits, including a recording of the custody redetermination hearing (ECF No. 6, Ex. 1) and the DHS exhibits submitted at the hearing (ECF No. 5-1), the Court concludes that the IJ faithfully applied the bond hearing standard set out in Hernandez-Lara v. Lyons, 10 F.4th 19 (1st Cir. 2021), and that her stated reasons for denying bond reflect that she considered and rejected alternatives to detention. Under 8 U.S.C. § 1226(e), "[n]o court may set aside any action by the Attorney General under this section regarding the detention of any alien or the revocation or denial of bond or parole." Given the clear statutory language and the absence of any indication that Mr. Haddad's due process rights were infringed at the hearing or by the IJ's articulated decision to deny bond, the Petition is DENIED. So Ordered by District Judge Melissa R. DuBose on 10/26/2026. (Urizandi, Nissheneyra)
