Order on Motion for Extension of Time to File Response/Reply
#14
Nov 04, 2026
Judge Myong J. Joun: ELECTRONIC ORDER entered. Respondents contend that Petitioner is subject to mandatory detention under 8 U.S.C. § 1226(c)(1)(A) because there is reason to believe that he engaged in, or knowingly assisted or participated in, illicit drug trafficking within the meaning of 8 U.S.C. § 1182(a)(2)(C)(i). In support, Respondents have submitted reports from the DEA. Doc No. 7-1. The reports, however, are redacted in material respects. Although they describe an undercover operation during which Petitioner allegedly transferred something to an undercover agent, the redactions obscure what was transferred, whether it was a controlled substance or listed chemical, and the circumstances supporting an inference that Petitioner knowingly participated in illicit trafficking. Without an adequate evidentiary basis concerning those matters, the Court cannot determine whether the statutory predicate for mandatory detention is satisfied.Accordingly, Respondents are ORDERED, by November 6, 2026, to supplement the record by submitting versions of the DEA reports with sufficiently limited redactions to permit the Court to evaluate the asserted trafficking ground, or by providing other competent evidence identifying the substance or item allegedly transferred and the facts supporting a reason to believe that Petitioner knowingly engaged in or assisted illicit trafficking. To the extent Respondents maintain that disclosure of material information would jeopardize that investigation, they may seek leave to submit the relevant evidence under seal or for in camera review, accompanied by an explanation of the need for such protection. Any such submission must nevertheless provide a sufficient factual basis for the Court to assess the applicability of § 1226(c)(1)(A). The Court reserves determination of the Petition pending supplementation of the record.(SP) (Entered: 11/04/2026)
