ORDER: Respondents must inform the Court of Petitioner's current location, and must include information about any other locations where Petitioner has been held and the dates of any transfers since his initial detention, by October 16, 2026 at 9:00 A.M. Respondents must also file a response to the writ—including any legal or factual arguments why the writ should not be granted—by October 16, 2026 at 9:00 A.M. If Respondents believe this case is unique, and raises issues separate and apart from those raised in similar petitions, and as a result require additional time to provide some or all of the information requested, in lieu of responding at 9:00 A.M., they may file a request for additional time with a short explanation for why this case raises unique issues not previously decided. The Clerk's office is directed to remove the restriction within this matter. So Ordered by Judge Sanket J. Bulsara on 10/14/2026. (CBS)

ORDER: To preserve the Court's jurisdiction pending final disposition of the 1 Petition, Respondents are enjoined from moving Petitioner to a location outside this District, the Southern District of New York, or the District of New Jersey absent further order of this Court. See, e.g., Loc. 1814, Int'l Longshoremen's Ass'n, AFL-CIO v. N.Y. Shipping Ass'n, Inc., 965 F.2d 1224, 1237 (2d Cir. 1992) ("Once the district court acquires jurisdiction over the subject matter of, and the parties to, the litigation, the All Writs Act [28 U.S.C. § 1651] authorizes a federal court to protect that jurisdiction."); Garcia-Izquierdo v. Gartner, No. 04 Civ. 7377, 2004 WL 2093515, at *2 (S.D.N.Y. Sep. 17, 2004) (observing that, under the All Writs Act, 28 U.S.C. § 1651, a district court "may order that a petitioner's deportation be stayed... when a stay is necessary to preserve the Court's jurisdiction of the case"); Khalil v. Joyce, No. 25 Civ. 1935, 2025 WL 750599, at *1 (S.D.N.Y. Mar. 10, 2025) (barring the government from removing petitioner from the United States until the Court could address his claim); Ozturk v. Hyde, 136 F.4th 382 (2d Cir. 2025) (declining to stay a district court order, issued pursuant to the All Writs Act, which transferred petitioner to the district court's territorial jurisdiction, given district courts' "undeniabl[e]... inherent authority to protect [its] proceedings" (citation modified)); cf. Michael v. I.N.S., 48 F.3d 657, 661-62 (2d Cir. 1995) (holding that the All Writs Act provides a federal court of appeals reviewing a final removal order with a basis to stay removal). The Clerk of the Court is respectfully directed to email a copy of this Order and the Petition to the United States Attorney's Office (USAO) for the Eastern District of New York. Petitioner's counsel shall also serve a copy of the order on the USAO. Ordered by Judge Nina R. Morrison on 10/14/2026. (LA)

Oct 21, 2026
ORDER: Now that the case has been reassigned to the undersigned, and in light of the documentary record and initial submissions on file, counsel for Respondents shall file a supplemental response to the Order to Show Cause issued by Judge Bulsara on October 14, 2026, focused on the following issues: (1) whether the instant case is distinguishable from the analysis set forth in this Court's earlier decisions in Diallo v. Lyons, 837 F.Supp.3d 422 (E.D.N.Y. 2026) and Garcia Tecu v. Mullin, No. 26-CV-5265 (NRM), 2026 WL 2655184 (E.D.N.Y. Sep. 9, 2026) and (2) whether, even if Respondents continue to respectfully disagree with the reasoning in those earlier decisions, and without foregoing the right to appeal from any relief that may be granted in the instant case on the basis of those decisions or any subsequent controlling authority, Respondents believe there is any need for a hearing or further briefing at this time. This supplemental response may take the form of a letter brief and shall be filed on or before 9a.m. on October 23, 2026. After reviewing Respondents' supplemental submission, the Court will determine whether there is any need for further written submissions, a hearing, or argument, including whether counsel for Petitioner shall file an Amended Petition (see Petitioner's reply 8 filed on October 20, 2026 at 8) and Respondents shall file a further response to the claims raised in an Amended Petition. All other orders of the Court, including all orders issued by Judge Bulsara while the case was assigned to him, remain in effect. Ordered by Judge Nina R. Morrison on 10/21/2026. (LA)
