TEXT ORDER: The Court has reviewed Respondents' Response (ECF No. 4). Respondents have identified 8 U.S.C. § 1226(a) as the statutory basis for Petitioner's detention. To the extent Petitioner challenges the lawfulness of his detention under 8 U.S.C. § 1226(a), the Court notes that a noncitizen detained pursuant to § 1226(a) may request a bond hearing before an Immigration Judge pursuant to 8 C.F.R. §§ 236.1(d)(1) and 1236.1(d)(1). See Jennings v. Rodriguez, 583 U.S. 281, 306 (2018). The record indicates that although Petitioner was scheduled to receive a bond hearing before an immigration judge to take place on October 15, 2026, Petitioner requested a continuance of the bond hearing, and the immigration judge scheduled a new bond hearing to take place on October 26, 2026. (ECF Nos. 4-2, 4-3, 4-4.) The Court, therefore, finds no basis to grant habeas relief on the present record. Accordingly, it is ORDERED that the Petition is DISMISSED. The Clerk of Court shall CLOSE this matter. So Ordered by Judge Jamel K. Semper on 10/26/2026. (sms) (Entered: 10/26/2026)
