ORDER DIRECTING THE FILING OF A RESPONSE. Petitioner concedes in his Petition for Writ of Habeas Corpus that he is subject to a final Order of Removal dated August 2, 2017. However, Petitioner argues that his current arrest and detention is unlawful because the 90-day removal period during which detention is mandatory has since expired under 8 U.S.C. § 1231(a)(1). Petitioner further argues that, because the 90-day mandatory detention period has expired, Petitioner's continued detention (which began on October 12, 2026) is unlawful under Zadvydas v. Davis, 533 U.S. 678 (2001). Finally, Petitioner argues that he was re-detained under § 1231(a) without being provided the individualized process governing continued civil confinement under 8 C.F.R. §§ 241.4 and 241.13. Specifically, Petitioner claims that he was not provided with the custody decision that must be provided to the detainee, which lists the reasons for the detainee's continued detention under § 241.4(d). Respondents are hereby ORDERED to file a Response to all of Petitioner's arguments made in his Petition for Writ of Habeas Corpus (ECF No. 1) within fourteen (14) days of this Order. Petitioner may then file a Reply within seven (7) days of the Response. Signed by Judge Mark R. Hornak on 10/19/26. Text-only entry; no PDF document will issue. This text-only entry constitutes the Order of the Court or Notice on the matter. (bdb) (Entered: 10/19/2026)

ORDER DISMISSING 1 PETITION FOR WRIT OF HABEAS CORPUS. The Court has received notice that the Petition for Writ of Habeas Corpus is moot because the Petitioner has been removed from the United States. (ECF No. 11, at 3). The Court agrees. In the Petition, Petitioner argues that his immediate release should be granted or, in the alternative, that the Court "should evaluate actual acceptance and travel-document evidence, the progress of removal efforts, and the practical likelihood of removal within a reasonably foreseeable period." (ECF No. 1, at 9). Now that Petitioner has been removed, both requests are moot. The 1 Petition for Writ of Habeas Corpus is denied, as moot, without prejudice. The Clerk will close the case on the docket without prejudice, and the Court retains jurisdiction over the action and the parties pending further proceedings, as may be appropriate, including interpretation or enforcement of its Orders. Signed by Judge Mark R. Hornak on 11/2/26. Text-only entry; no PDF document will issue. This text-only entry constitutes the Order of the Court or Notice on the matter. (bdb) (Entered: 11/02/2026)
