TEXT ORDER: The Court, having reviewed Respondents' expedited response (ECF No. 4), finds that Petitioner has been afforded two bond hearings before an Immigration Judge pursuant to 8 U.S.C. § 1226(a), including a subsequent hearing based on changed circumstances, and that the Immigration Judge denied release on bond following each hearing. To the extent Petitioner challenges the Immigration Judge's most recent bond determination, he must first pursue the available administrative remedy by appealing that determination to the Board of Immigration Appeals ("BIA"), pursuant to 8 C.F.R. §§ 1003.1(b)(7), 1003.19(f), and 1003.38. An appeal generally must be filed within 30 calendar days of the Immigration Judge's decision. See 8 C.F.R. § 1003.38(b). Petitioner should consult the Immigration Judge's written decision and the applicable filing instructions regarding the deadline, required forms, and filing procedures. If the BIA denies relief, Petitioner may seek judicial review to the extent permitted by law, including by filing a petition for review in the appropriate United States Court of Appeals if the challenged decision is reviewable. See 8 U.S.C. § 1252. Because the record does not establish that Petitioner has exhausted the available administrative remedies concerning his bond determination, the Court will not review the merits of that determination in this action. Accordingly, the Petition is DISMISSED WITHOUT PREJUDICE to Petitioner's ability to seek habeas relief, if otherwise appropriate, after exhausting available administrative remedies. The Clerk of Court is directed to CLOSE this case. So Ordered by Judge Jamel K. Semper on 10/21/2026. (sms) (Entered: 10/21/2026)
