District Judge Angel Kelley: ELECTRONIC ORDER entered. Before the Court is Petitioner Ronald Louis’ Petition for Writ of Habeas Corpus. [Dkt. 1]. Respondents submit that the legal issues presented in this Petition are “similar to those recently addressed by this Court” in Gomes Cardoso v. Hyde, No. 25-CV-13935-AK, 2026 WL 468200 (D. Mass. Feb. 19, 2026),” and that “[s]hould the Court follow its logic and reasoning in Gomes Cardoso, it would reach the same result here.” [Dkt. 8]. In Gomes Cardoso, this Court held that full due process protections apply to non-citizens who have been paroled into the United States under 8 U.S.C. § 1182(d)(A), and that the Due Process Clause is violated when such non-citizens are subject to mandatory detention without notice or opportunity to be heard. On the facts before it, the Court does not find reason to deviate from the analysis presented in Gomes Cardoso. Accordingly, Petitioner is entitled to a bond hearing.Petitioner’s Petition [Dkt. 1] is GRANTED. Respondents are ORDERED to provide Petitioner with a bond hearing under 8 U.S.C. § 1226(a) within ten (10) calendar days of this Order, subject to any request for continuance from Petitioner. Respondents are ENJOINED from denying Petitioner bond on the basis that he is detained pursuant to 8 U.S.C. § 1225(b)(2). The parties are further ORDERED to file a status report within fourteen (14) calendar days of this Order stating whether Petitioner has been granted bond, and, if the request for bond was denied, the reasons for that denial.(CEH) (Entered: 10/14/2026)
