Judge Brian E. Murphy: ELECTRONIC ORDER. Respondents represent that Petitioner is subject to a final order of removal from the United States, as well as subject to reinstatement of this removal order as authorized by 8 U.S.C. § 1231(a)(5), and that he has been detained for less than one month, since October 1, 2026. Dkt. 8 at 3-6. The Court ordered Petitioner to show cause as to why the petition should not be denied, see Dkt. 9, and Petitioner did not rebut Respondent's argument, see Dkt. 11 . On the record before the court, Petitioner’s detention appears to be authorized by § 1231(a)(5). See Zadvydas v. Davis, 533 U.S. 678, 700–01 (2001). Accordingly, the petition is DENIED.
