ORDER SETTING BRIEFING SCHEDULE AND VACATING REFERENCE TO THE MAGISTRATE JUDGE by Judge Stanley Blumenfeld, Jr.: Petitioner filed a petition for a writ of habeas corpus 1 and an application for a temporary restraining order (TRO) 2 . General Order 26-05 establishes an expedited briefing schedule for immigration habeas petitions in recognition of the inherent exigency of immigration detention. A petitioner seeking relief on an even more expedited basis must therefore demonstrate imminent, irreparable harm that cannot be addressed by the General Order's schedule. Petitioner has not done so, as he previously filed a substantially similar habeas petition and TRO application that this Court denied. See Sanford Ironio Fernandes, No. 5:26-cv-03102-SB-SSC, Dkt. Nos. 10, 12 (C.D. Cal.). If the government does not oppose the relief sought in the TRO application or petition, it shall promptly notify the Court.Otherwise, the government shall file a response by 10/13/2026. It its response, the government shall address the statutory basis for detention, whether this second petition is barred under the abuse-of-writ doctrine, Petitioner's claims for ineffective assistance, and whether conditions of confinement are properly raised under 28 U.S.C. section 2241. Petitioner shall file a reply, if any, no later than 10/27/2026. The Court vacates the reference of this action to the assigned magistrate judge, pursuant to General Order 05-07. (SEE DOCUMENT FOR FURTHER DETAILS.) (gk) (Entered: 10/07/2026)
