ORDER: On September 21, 2026, a petition was filed by Petitioner's niece, Rocio Santiago, in Bobadilla v. Warden et al (26-cv-5829-RPK). (Pet., ECF No. 1, 26-cv-5829-RPK.) On October 2, 2026, Judge Kovner dismissed that petition in light of Petitioner's representation that he wished to pursue his own habeas corpus petition. (Oct. 2, 2026, Order, 26-cv-5829-RPK.) On October 5, 2026, Petitioner filed the instant petition (the "Petition"). (Pet., ECF No. 1.) On October 6, 2026, the Court issued an order to show cause as to why the Petition should not be granted. On October 21, 2026, the Government filed its response. In its response, the Government here again stated that Petitioner did not file the Petition, notwithstanding that the Petition bears Petitioner's name. (See Resp., ECF No. 4.) In light of the Government's representation, the Petitioner is directed to attest by written submission to the Court whether or not he filed the Petition, or if it was filed by someone else on his behalf but bearing his name. To the extent Petitioner filed the instant Petition, Petitioner is directed to show cause as to why the Petition is not moot in light of Petitioner's request for Voluntary Departure. Ordered by Judge LaShann DeArcy Hall on 10/22/2026. (CG) C/M as to petitioner on 10/23/2026. (MLR).
