The facts alleged do not rise to a due process violation because Petitioner has only been detained for seven months, and he doesn't argue that the individualized bond hearing he received as required by 8 U.S.C. § 1226(a) was fundamentally unfair. See Borbot v. Warden Hudson Cnty Corr. Facility, 906 F. 3d 274, 27680 (3d Cir. 2018). Additionally, because Petitioner's appeal is pending, Section 1231 doesnt apply. 8 U.S.C. § 1231(a)(1).
