TEXT ORDER: The Court has reviewed Petitioner's October 6, 2026 letter (ECF No. 4), and Respondents' October 7, 2026 letter (ECF No. 5). Respondents confirm that Petitioner is detained pursuant to 8 U.S.C. § 1226(a) and that ICE issued a Form I-286, Notice of Custody Determination, on September 30, 2026, authorizing Petitioner's release upon payment of a $7,500 bond. (ECF No. 5 at 1; ECF No. 4-1.) Respondents further state that Petitioner received a bond hearing on October 5, 2026, but withdrew his request. (ECF No. 5.) The record, however, does not make clear whether the September 30, 2026 Form I-286 remains operative or, if it does, why Petitioner has been unable to effectuate his release upon payment of the $7,500 bond. Accordingly, Respondents shall, within 2 days, file a letter to advise the Court whether the September 30, 2026 Form I-286 remains in effect and, if so, whether Petitioner may obtain release upon payment of the $7,500 bond. If Respondents contend that the Form I-286 has been withdrawn, superseded, or otherwise rendered inoperative, Respondents shall identify the applicable custody determination and provide a copy thereof.
