MINUTE ORDER Denying Without Prejudice Petition. Presently before the Court is Petitioner Victor Antonio Mejia Sanchez's 1 Petition for Writ of Habeas Corpus Under 28 U.S.C. § 2241. Petitioner received a bond hearing on August 27, 2026, (see ECF No. [4-2]), and now seeks relief from the Immigration Judge's denial of bond. Although the Court wishes it could reunite Petitioner with his eight-year-old daughter--who is recovering from a bone marrow transplant to treat relapsed acute myeloid leukemia, (see ECF No. [5-1])--because Petitioner has failed to exhaust his administrative remedies by appealing to the Board of Immigration Appeals and has not raised any basis for waiving exhaustion, the Court necessarily DENIES WITHOUT PREJUDICE the 1 Petition. See Leonardo v. Crawford, 646 F.3d 1157, 1161 (9th Cir. 2011) (remanding with the instruction to dismiss the petition without prejudice because the petitioner had not exhausted his administrative remedies or demonstrated grounds for excusing exhaustion).
