MINUTE ORDER by District Judge Robert S. Huie: The Petition raises the claim that Petitioner was arrested without a warrant in violation of the APA and the Constitution. The government's return attaches an arrest warrant dated the same day as Petitioner's arrest, but the return does not address (1) whether Petitioner's arrest was effectuated pursuant to that warrant, or whether the warrant was issued after the arrest; or (2) in the event Petitioner's arrest was not made pursuant to a then-existing warrant, the legal and factual basis for a warrantless arrest. The government shall have until 11/4/26 to file a supplemental response addressing relevant legal authority and supported by evidence as warranted.
