ORDER: Before the Court is Respondents' Status Report Pursuant to Order (ECF No. 6 ). ECF No. 9 . In the status report, counsel for Respondents states the following: "Undersigned counsel submits this status report for Respondents based on information received from U.S. Immigration and Customs Enforcement. Petitioner was released from immigration custody on October 27, 2026, was immediately re-detained, and remains in detention. Respondents will not be submitting a brief that argues that the current detention is lawful." ECF No. 9 at 1. Given these representations from Respondents themselves - that Petitioner was immediately detained upon release, and that Respondents "will not be submitting a brief" arguing that Petitioner's current detention is "lawful" - the Court ORDERS Respondents' counsel to appear for an in-person hearing on November 4, 2026, at 11:00 a.m. MST at the U.S. District Courthouse, Courtroom A702, 7th floor, 901 19th Street, Denver, Colorado. Counsel for Respondents shall ensure that an appropriate official from U.S. Immigration and Customs Enforcement (ICE) will be in attendance, who can explain: when Petitioner's re-detention occurred; why the re-detention occurred; and where the re-detention occurred. ICE shall ensure Petitioner's attendance at the hearing, either by ensuring his presence in-person or by telephone or videoconference. The Court orders Respondents' counsel to confirm how Petitioner will appear by emailing Sweeney_Chambers@cod.uscourts.gov at least two hours prior to the hearing. The Court reiterates that counsel for Respondents and an appropriate ICE official are required to appear in-person. No requests by Respondents for an extension of time, re-scheduling the hearing, or holding the hearing virtually shall be entertained. By Judge Charlotte N. Sweeney on 11/3/2026. For all non-e-filer pro se parties, a copy of this document has been sent via U.S. Mail to the mailing address of record. Text Only Entry (cnsja, ) (Entered: 11/03/2026)
