MINUTE ORDER (Text Only Entry). The Court has reviewed the Petition for Writ of Habeas Corpus, ECF No. 1, and Motion for Temporary Restraining Order ("TRO") and Preliminary Injunction, ECF No. 2 . Due to the urgent nature of the requested relief, the Court intends to rule directly on the Petition and will also consider the arguments and exhibits submitted in support of the Motion for TRO. Respondents shall file a response to the Petition by October 7, 2026. The response shall address the statutory and factual bases for Petitioner's current detention, the circumstances of his initial entry and any prior release, the circumstances of his August 2026 arrest, whether he has requested or received a bond hearing, and the current status of his removal proceedings. Respondents shall specifically address the application of Rodriguez Vazquez v. Bostock, 183 F.4th 1160 (9th Cir. 2026), to Petitioner's detention. Respondents shall also address whether Petitioner was arrested pursuant to a warrant and, if not, the factual and legal bases for the warrantless arrest. Any response must include Petitioner's (A-File # 241-791-793) full and complete Form I-213, any notices to appear, any orders of release or detention, any arrest warrants and custody determinations or notices, any records of bond proceedings, and any other portions of Petitioner's A-File relevant to the issues presented, including available documentation concerning his prior release or supervision and any alleged violations of its conditions. Failure to timely respond shall be construed as a non-opposition. See L.R. 230(c). Petitioner may file a reply by October 14, 2026. Pending a ruling on the Petition for Writ of Habeas Corpus, Respondents shall not transfer Petitioner out of this District without prior Court approval. See F.T.C. v. Dean Foods Co., 384 U.S. 597, 608 (1966) (noting the court's "express authority under the All Writs Act to issue such temporary injunctions as may be necessary to protect its own jurisdiction"). ORDER to SHOW CAUSE: On October 8, 2026, the Court ordered Respondent to provide Petitioner an individualized bond hearing within ten days, unless Petitioner requested a later date. ECF No. 8 at 2. The Court required Respondent to immediately release Petitioner if the required hearing did not occur within that period, absent an extension requested by Petitioner. Id. at 3. Petitioner now moves to enforce the judgment and for immediate release, declaring that, as of October 28, 2026, he remained detained without a bond hearing and had not requested an extension. Id. at 5. By November 4, 2026, Respondent SHALL SHOW CAUSE why Petitioner's Emergency Motion to Enforce Judgment and for Immediate Release, ECF No. 10, should not be granted. The response shall be supported by declarations based on personal knowledge and relevant records addressing compliance with the Court's October 8, 2026, Order. If Respondent contends that a bond hearing occurred or that Petitioner requested an extension, Respondent shall provide supporting records, including any hearing notice, recording, and decision or documentation of the requested extension. If the required hearing did not occur within the prescribed period, Respondent shall explain why Petitioner was not released. Respondent's counsel SHALL promptly transmit this Order to ICE and Petitioner's current custodian. The Clerk of Court is directed to update Petitioner's address to California City (ICE), P.O. Box 2513, 22844 Virginia Blvd., California City, CA 93505, and serve him with copies of this Order and ECF Nos. 8 and 9. signed by District Judge Mary K Dimke on 11/3/2026. Show Cause Response due by 11/4/2026. TEXT ONLY. (Deputy Clerk LLH) (Entered: 11/03/2026)

SECOND ORDER TO SHOW CAUSE (Text Only Entry): Respondent reports that Petitioner was released on November 4, 2026, and requests that his motion be denied as moot. ECF No. 12 at 1. Respondent acknowledges that the bond hearing scheduled for October 16, 2026, was canceled following Petitioner's transfer from Adelanto to California City and that neither DHS nor EOIR sought to reschedule the hearing by the Court's deadline. Id. The response does not explain why Petitioner remained detained until November 4, 2026, despite the requirement that he be immediately released if the required hearing did not timely occur. ECF No. 8 at 3. It also does not include the declarations required by the Court's November 3, 2026, Order to Show Cause. ECF No. 11 . The response also raises questions about the circumstances of Petitioner's transfers. The Court's October 1, 2026, Order prohibited transferring Petitioner outside this District without prior Court approval pending a ruling on the petition. ECF No. 6. The Court ruled on October 8, 2026. ECF No. 8 . Respondent does not identify when or why Petitioner was moved from Central Valley Annex to Adelanto, which is outside this District. By November 6, 2026, Respondent shall file a supplemental response supported by declarations based on personal knowledge and relevant records. Respondent shall identify the dates, reasons, and officials responsible for Petitioner's transfers from Central Valley Annex to Adelanto and from Adelanto to California City, including whether he was moved to Adelanto for the required bond hearing. For any transfer outside this District while ECF No. 6 remained in effect, Respondent shall explain compliance with that Order. Respondent shall provide the relevant transfer records, including the Form I-830 referenced in the immigration judge's October 14, 2026, decision. ECF No. 12 -2 at 1. Respondent shall explain whether the immigration judge received the Court's October 8, 2026, Order before canceling the hearing, why no timely hearing was rescheduled, and why Petitioner was not released when the hearing deadline expired. The response shall identify when the officials responsible for implementing the Order received it, the steps taken to comply, and the circumstances that prompted Petitioner's release on November 4, 2026. Petitioner's Emergency Motion to Enforce Judgment and for Immediate Release, ECF No. 10, is DENIED as moot in light of his release. Signed by Visiting Judge Mary K Dimke on November 4, 2026.
