Response to Order to Show Cause
#11
Oct 15, 2026
ORDER DIRECTING RESPONDENTS TO SHOW CAUSE. Petitioner argues that he was arrested on August 31, 2026, without a warrant, and therefore, that his present detention cannot be justified under 8 U.S.C. § 1226(a). (ECF No. 9, at 6). In their Response, Respondents note that an arrest warrant was drafted and read to Petitioner on September 1, 2026. (ECF No. 7, at 34). However, Respondents do not address the authority for Petitioner's initial arrest which occurred on August 31, 2026. (ECF No. 7-1, at 3) (noting that on August 31, 2026, Petitioner was "placed under arrest and transported to the York ERO Sub-Office to be detained in ICE custody."). Respondents are ORDERED to SHOW CAUSE the authority for the arrest of Petitioner on August 31, 2026, and whether a warrant was required to effectuate that arrest. Beyond Respondent's Response to this Order, no further briefing regarding the Petitioners Petition for Writ of Habeas Corpus may be filed on the Court's docket without further leave from the Court. Signed by Judge Mark R. Hornak on 10/15/26. Text-only entry; no PDF document will issue. This text-only entry constitutes the Order of the Court or Notice on the matter. (bdb) (Entered: 10/15/2026)
