ORDER (AGS): In light of petitioner's written response, the Order to Show Cause (ECF 2 ) is discharged. Based on his written representation (ECF 4 ) and request for counsel (ECF 1, at 7), the Court provisionally appoints Federal Defenders of San Diego, Inc., to determine whether petitioner qualifies for representation by that organization for this petition. The Clerk is directed to forward a copy of this order to Federal Defenders at CAS_2241@fd.org. By October 30, 2026, Federal Defenders must submit a notice to the Court detailing whether it will accept the appointment. If it accepts appointment and files an amended petition, the Court adopts the Standard Procedures from Chief Judge Order No. 144 for that amended petition. Additionally, if it accepts appointment, Federal Defenders must state whether it will pursue petitioner's motion for reconsideration in 26-cv-4041-AGS-MMP. The Court sets a hearing on both the habeas petition and the reconsideration motion for November 17, 2026, at 2:00 p.m. Signed by District Judge Andrew G. Schopler on 10/16/2026.
