Emergent Immigration Habeas Non-transfer Order
#5
Oct 01, 2026
TEXT ORDER: The Court has reviewed Respondents' correspondence at ECF No. 4 concerning Petitioner's transfer to Winn Correctional Center in Louisiana on September 26, 2026. Because a district court retains jurisdiction over a properly filed petition for a writ of habeas corpus under 28 U.S.C. § 2241 notwithstanding a subsequent transfer of the petitioner outside the district, see Anariba v. Dir. Hudson Cnty. Corr. Ctr., 17 F.4th 434, 445-46 (3d Cir. 2021), the timing of Petitioner's transfer is material. Moreover, under the prison mailbox rule, a pro se prisoner's filing is deemed filed when delivered to prison authorities for mailing. See Houston v. Lack, 487 U.S. 266, 275-76 (1988); Burns v. Morton, 134 F.3d 109, 112-13 (3d Cir. 1998). Accordingly, Respondents shall, within 3 days of the date of this Order, certify the date and time on which Petitioner was transferred from New Jersey and, if available, the date and time on which Petitioner delivered the Petition to prison authorities for mailing. So Ordered by Judge Michael A. Shipp on 10/1/2026. (jab) (Entered: 10/01/2026)
