Enforce Judgment

Oct 23, 2026
District Judge F. Dennis Saylor, IV: ELECTRONIC ORDER entered re 15 First MOTION to Enforce Judgment filed by Maicon Modolo. On October 22, 2026, the Court ordered petitioner's release from custody, on his prior order of supervision, no later than 5 p.m. local time today, October 23. Petitioner has filed an emergency motion for an order directing respondents to facilitate petitioner's transportation to Massachusetts, the district in which he was detained when he filed his habeas petition—the event establishing this Court's jurisdiction—and when the Court entered its stay order. (Dkt. No. 15 ). The motion does not disclose petitioner's present location. Under the totality of the circumstances, the Court agrees that facilitation of petitioner's return to the District of Massachusetts is appropriate, including to provide for his orderly release on an OSUP. Accordingly, respondents SHALL contact petitioner's counsel to facilitate his prompt return to Massachusetts. They SHALL return petitioner's personal belongings in their possession, to the extent they have not yet done so. Respondents' October 26 status report, previously ordered by the Court, shall describe their compliance with this Order. Petitioner's motion is GRANTED to the extent described above. (BEL) Modified on 10/23/2026 to correct typo (BEL). (Entered: 10/23/2026)
