Order on Motion to Appear Pro Hac Vice

ORDER DENYING 2 Petition for Writ of Habeas Corpus. Petitioner, a noncitizen detained by Respondents at Moshannon Valley Processing Center at the outset of this case, asks this Court to order his immediate release, or alternatively, order that he receive an individualized bond hearing before an immigration judge under 8 U.S.C. § 1226(a). ECF No. 2. At this juncture, Petitioner has received an individualized bond hearing under § 1226(a). See ECF Nos. 7 (Response) at 2; 7-7 (Notice of Hearing) at 2; 8 (Reply) at 2 ("Petitioner has now received a bond hearing."). So Petitioner's request for an individualized bond hearing is moot. In seeking immediate release, Petitioner "challenges the constitutional adequacy" of Section 1226(a) and related regulations placing "the burden of establishing eligibility for release" on to the noncitizen rather than the government. ECF No. 8 at 2; see also 8 U.S.C. 1226(a); 8 C.F.R. § 236.1(c)(8). Petitioner's challenge fails under Borbot v. Warden Hudson Cnty. Corr. Facility, which teaches that requiring noncitizens to shoulder the burden of establishing eligibility for release in Section 1226(a) bond and bond redetermination hearings comports with due process. 906 F.3d 274, 278-79 (3d Cir. 2018); see also Coto-Henriquez v. Dep't of Homeland Sec., No. 23- 271, 2023 WL 2333309, at *2 (M.D. Pa. Mar. 2, 2023); Bertin B.-S. v. Rodriguez, No. 20-4749, 2020 WL 3264087, *2 (D.N.J. June 17, 2020). Finally, to the extent that Petitioner challenges his particular 10/15/2026 bond hearing as violating due process, that also fails. Petitioner has not provided the Court with a transcript or recording of the hearing. See generally ECF Nos. 2, 8. So the Court has no basis to conclude that the hearing lacked the three essential elements of a "fundamentally fair" bond hearing under the test set forth by the United States Court of Appeals for the Third Circuit in Ghanem v. Warden Essex Cnty. Corr. Facility, No. 21-1908, 2022 WL 574624, at *2 (3d Cir. Feb. 25, 2022). Thus, Petitioner, who bears the burden of demonstrating he is entitled to relief, has failed to show that the 10/15/2026 hearing violated due process. Accordingly, IT IS HEREBY ORDERED that the 2 Petition for Writ of Habeas Corpus is DENIED. Signed by Judge Christy Criswell Wiegand on 10/26/2026. Text-only entry; no PDF document will issue. This text-only entry constitutes the Order of the Court or Notice on the matter. (tmc) (Entered: 10/26/2026)
