ORDER denying 5 Motion for Temporary Restraining Order and Motion for Preliminary Injunction for lack of jurisdiction. Petitioner, a native of the People's Republic of China, is currently detained at Moshannon Valley Correctional Center, and seeks to enjoin Respondent(s) from executing a removal order pending resolution of pending administrative processes and the Petition for Writ of Habeas Corpus pending before the Court. Congress has divested federal courts of authority "to hear any cause or claim by or on behalf of any alien arising from the decision by the Attorney General to commence proceedings, adjudicate cases, or execute removal orders against any alien under this chapter." 8 U.S.C. § 1252(g). The Third Circuit has concluded, under § 1252(g), that district courts lack jurisdiction to enjoin removal of aliens pending exhaustion of the provisional-waiver and BIA processes. Tazu v. Att'y Gen. United States, 975 F.3d 292, 296-98 (3d Cir. 2020) ("The Attorney General may thus decide to execute Tazu's valid removal order when he chooses. The statute shields that prosecutorial discretion from judicial review apart from a petition for review."); see also Khan v. U.S. Dept of Homeland Sec., No. 25-CV-14246, 2025 WL 3720100, at *4 (D.N.J. Dec. 23, 2025) ("To the extent Petitioner seeks to stay or enjoin the execution of his final order of removal pending resolution of his motion to reopen before the BIA, this Court lacks jurisdiction under § 1252(g)."). Consistent with this authority, this Court concludes that it lacks jurisdiction to enjoin Petitioner's removal order. Accordingly, IT IS HEREBY ORDERED that Petitioner's 5 motion is DENIED. Signed by Judge J. Nicholas Ranjan on 10/9/2026. Text-only entry; no PDF document will issue. This text-only entry constitutes the Order of the Court or Notice on the matter.
