TEXT ORDER: The Court has reviewed Respondents' correspondence regarding Petitioner's detention authority (ECF No. 4 ), filed pursuant to the Court's September 25, 2026, Order (ECF No. 2 ), as well as Petitioner's allegations concerning the length and circumstances of his detention (ECF No. 1 ). Respondents represent that Petitioner is presently detained pursuant to 8 U.S.C. § 1226(a), pending removal proceedings, and that an Immigration Judge denied Petitioner's request for release on bond on March 2, 2026. Respondents shall, within seven days, file a supplemental submission addressing the likelihood and anticipated timing of Petitioner's removal, together with documentary evidence concerning the steps taken to effectuate his removal. In particular, Respondents shall address: (1) whether Petitioner presently possesses a valid passport or other travel document necessary for removal to his country of citizenship; (2) if Petitioner does not possess such documentation, when Respondents first determined that travel documentation was required and the date on which Respondents first requested or initiated efforts to obtain it; (3) each request made to the relevant consular authority for travel documentation, including the date of each request and the status of each request; (4) whether the relevant consular authority has issued, declined to issue, or indicated that it will issue travel documentation for Petitioner, and, if issuance is anticipated, the expected date of issuance; (5) any other impediment presently preventing Petitioner's removal; (6) the steps Respondents have taken since March 2, 2026, to effectuate Petitioner's removal; and (7) whether Petitioner has been identified, assigned, or scheduled for a particular removal flight and, if so, the anticipated date of that flight. Respondents shall support their representations concerning travel documentation and removal with documentary evidence, including copies of any requests, correspondence, responses, travel-document applications, or other records demonstrating the status of efforts to obtain the documentation necessary to effectuate Petitioner's removal. If Respondents contend that Petitioner's removal is reasonably foreseeable despite the absence of presently available travel documentation, Respondents shall identify the factual basis for that contention and the anticipated timeframe for removal. Respondents shall also address Petitioner's contention that his continued detention under 8 U.S.C. § 1226(a) has become unreasonably prolonged and that changed circumstances warrant his immediate release or, alternatively, a new bond hearing. In particular, Respondents shall address whether the present circumstances--including the status of any travel documentation and the anticipated timing of removal--support continued detention under § 1226(a), and whether any delay in effectuating Petitioner's removal is attributable to Respondents, Petitioner, or circumstances beyond either party's control. The Court reserves decision on the Petition pending receipt of the supplemental submission. Respondents shall file any supplemental submission within seven days of the date of this Text Order. So Ordered by Judge Michael A. Shipp on 10/7/2026. (jab) (Entered: 10/07/2026)
