Judge Allison D. Burroughs: ELECTRONIC ORDER entered. Currently before the Court is Petitioner Alfredo Ramirez Cojon’s petition for writ of habeas corpus. [ECF No. 1 ]. Petitioner’s habeas petition asks this Court to order the government to provide him with a bond hearing under 8 U.S.C. § 1226(a). [ECF No. 1 at 8]. The government concedes that Petitioner is detained pursuant to 8 U.S.C. § 1226(a) and that he thus is eligible for a bond hearing, [ECF No. 8 at 1], but represents that Petitioner has not yet requested one before the Immigration Court, [id.].Other sessions, including this Court, and other courts around the country have denied habeas petitions filed by individuals who are eligible to seek bond in immigration court, but have failed to make such a request. See e.g., Quinonez Mercado as next friend of Abarca-Jovel v. Dep't of Homeland Sec., No. 25-CV-12066, 2025 WL 2430423, at *3 (D. Mass. Aug. 22, 2025) (denying petition for failure to exhaust as petitioner was entitled to seek a bond hearing before an IJ and failed to do so); Dos Santos v. Moniz, No. 26-cv-11978-ADB, ECF No. 8 (D. Mass. May 12, 2026) (denying petition by bond eligible petitioner because bond relief has not been exhausted); Harrar v. Moniz, 26-cv-11340, ECF No. 8 (D. Mass. April 6, 2026) (denying petition as petitioner had failed to request bond hearing in Immigration Court); Kalangi v. Moniz, 26-cv-11424, ECF No. 8 (D. Mass. April 1, 2026) (dismissing petition filed by bond-eligible Petitioner as he “is required to exhaust administrative remedies before seeking habeas relief.”); Reyes Vargas v. Moniz, 1:26-cv-11320, ECF No. 10 (D. Mass. March 25, 2026) (“When a noncitizen’s habeas petition is governed by this discretionary detention framework, and they have failed to exhaust their administrative remedies... dismissal of the habeas petition is warranted.”). Accordingly, Petitioner’s petition is DENIED with leave to renew if Petitioner is not promptly provided with a bond hearing after requesting such relief before an immigration judge.
