PAPERLESS ORDER. THIS CAUSE comes before the Court upon the Status Report filed by Respondent on October 7, 2026 (the "Status Report"). ECF No. 9 . In the Status Report, Respondent states that the Immigration Judge "denied Petitioner bond, indicating that he was subject to mandatory detention pursuant to the Laken Riley Act, 8 U.S.C. § 1226(c)(1)(E)." Id. The Immigration Judge's Order provides that Petitioner's request for a change in custody was denied because "[t]he court lacks jurisdiction - mandatory detention under U.S.C. § 1236(c)(1)(E) [sic]." ECF No. [9-1]. However, in this Court's Order Granting in Part Petition for Writ of Habeas Corpus, the Court determined that "Petitioner's detention is governed by 8 U.S.C. § 1226(a)" and, as such, "Petitioner is entitled to an individualized bond hearing." ECF No. 8 . Accordingly, Respondent is hereby ORDERED to promptly afford Petitioner an individualized bond hearing consistent with 8 U.S.C. § 1226(a) by no later than October 14, 2026. The bond hearing must consider whether Petitioner is a danger to the community or a risk of flight. Petitioner's immigration status alone cannot be the basis for which bond is denied. Respondent shall, within twenty-four (24) hours of the bond hearing, file a Status Report indicating the outcome of the bond hearing and, if release on bond is denied, the reason(s) for the denial.
