Judge Myong J. Joun: ELECTRONIC ORDER entered. The government has informed the Court that Petitioner was “inadvertently” transferred to the Wyatt Detention Center on the evening of September 23, 2026, hours after this Court entered its service order. The government further represents that ICE Enforcement and Removal Operations (“ERO”) Boston did not become aware of the petition or the Court’s order until the morning of September 25. The Court does not find that explanation sufficient. The United States Attorney’s Office received notice of this Court’s order nearly two days before ERO Boston was informed of it. Once the government received an order restricting Petitioner’s transfer or removal, counsel had an obligation to communicate that order promptly to the relevant ICE officials so that the Court’s directives could be followed. In light of the government’s failure to timely communicate the Court’s order, and because Petitioner expressly objects to remaining detained at Wyatt, Respondents are hereby ORDERED to transfer Petitioner back to the District of Massachusetts immediately. If Respondents thereafter seek to transfer Petitioner outside the District of Massachusetts, they shall comply with this Court’s prior service order, including its requirement that Petitioner’s counsel receive at least 72 hours’ advance notice of any such transfer. Respondents are further ORDERED to file, on or before Monday, September 28, 2026, a status report confirming compliance with this Order, including confirmation that Petitioner has been returned to the District of Massachusetts.(SP) (Entered: 09/25/2026)
