TEXT ORDER: The Court has reviewed Respondents' correspondence at ECF No. 4 . Although Respondents report that ICE issued a Notice of Custody Determination on September 9, 2026, and that Petitioner's custody redetermination hearing is scheduled for September 29, 2026, the correspondence does not address all of the information requested in the Court's September 22, 2026 Order at ECF No. 2, including whether Petitioner has a criminal history, whether Petitioner is subject to a final order of removal, and the statutory authority under which Petitioner is detained. Accordingly, Respondents shall file, by October 1, 2026, a supplemental status letter advising the Court of the outcome of the September 29, 2026 custody redetermination hearing and addressing each of the foregoing matters. TEXT ORDER: The Court has reviewed Respondents' supplemental status letter at ECF No. 6. Respondents represent that Petitioner is detained pursuant to 8 U.S.C. § 1226(a), is not subject to a final order of removal, and has no criminal history. Respondents further represent that, on September 9, 2026, U.S. Immigration and Customs Enforcement issued a Notice of Custody Determination authorizing Petitioner's release upon the posting of a $7,500 bond. (ECF No. 6 at 1-2; ECF No. 6-1.) Respondents further advise that Petitioner's custody redetermination hearing before an Immigration Judge has been rescheduled to October 6, 2026.To the extent Petitioner seeks release pursuant to the $7,500 bond authorized by ICE, Respondents shall facilitate Petitioner's release upon the posting of that bond, subject to any other lawful basis for his detention. Respondents shall file a status letter within three (3) days of the posting of bond advising the Court whether Petitioner has been released. If Petitioner has been released, the Clerk of Court shall CLOSE this matter. If Petitioner has not posted bond, Respondents shall so advise the Court, and the matter shall remain open pending further Order of the Court. Nothing in this Order shall preclude Petitioner from seeking a redetermination of the bond amount before an Immigration Judge pursuant to 8 C.F.R. §§ 236.1(d)(1), 1236.1(d)(1), and 1003.19.
