District Judge F. Dennis Saylor, IV: ELECTRONIC ORDER entered. The Court has reviewed the petition for a writ of habeas corpus filed by Julio Lorenzo Alvarado, a national of Mexico; the response, which includes a motion to dismiss under Federal Rule of Civil Procedure 8; and the opposition thereto. (Dkt. No. 1 ; Dkt. No. 7 ; Dkt. No. 8 ). The Court’s prior order directed that the “response to the petition shall address whether the First Circuit’s decision in Guerrero Orellana v. Moniz, Nos. 25-2152, 26-1094 (1st Cir. Aug. 13, 2026), controls this matter.” (Dkt. No. 5 at 1). On this point, the response states only that “it appears that Petitioner may be subject to the First Circuit’s decision in Guerrero-Orellana, No. 25-2152, 2026 WL 2352042, at *1, 7 (1st Cir. Aug. 13, 2026).” (Dkt. No. 7 at 5-6). Though respondents contend the petition is inadequately pleaded, they identify no specific factual deficiencies preventing them from “address[ing] whether” Guerrero Orellana “controls this matter,” as the Court directed. See id.; see also 28 U.S.C. § 2243 (“The person to whom the writ or order is directed shall make a return certifying the true cause of the detention.”). Indeed, the factual allegations in the petition enabled respondents to locate a criminal-history record for petitioner, demonstrating their possession of pertinent records. (Dkt. No. 7 -1). Accordingly, on or before October 5, 2026, respondents shall supplement their answer by addressing whether the First Circuit’s decision in Guerrero Orellana v. Moniz, Nos. 25-2152, 26-1094 (1st Cir.
