Answer/Response to Petition for Writ of Habeas Corpus - 2241
#10
Oct 09, 2026
Judge Richard G. Stearns: ELECTRONIC ORDER entered re 9 Response to Petition for Writ of Habeas Corpus - 2241 filed by Markwayne Mullin, David Wesling, Todd W. Blanche, and Department of Homeland Security. Petitioner Roman Pyvo has filed a habeas request asking for release from detention as he has applied for Temporary Protected Status. The petition is his second. See Pyvo v. Moniz, 26-cv-11816-RGS (D. Mass. 2026). In his initial case, the court ordered a bond hearing. Bond was denied and Pyvo filed a Motion to Enforce Judgment. Id. The court Stayed the matter pending the exhaustion of the bond appeals process. Id. That case was dismissed on July 14, 2026, by an Assented to Motion to Dismiss. The governments position here is that the court should deny Pyvo's petition because his recourse was to exhaust administrative remedies by appealing the immigration judge's decision to the Board of Immigration Appeals (BIA), as Pyvo had reserved his right to do, citing 8 C.F.R. § 236.1(d)(3)(i) (Applicable regulations allow a second bond hearing before an immigration judge on a non-citizen's request "upon a showing that the [non-citizen's] circumstances have changed materially since the prior bond redetermination." 8 C.F.R. § 1003.19(e).)." Gov't Resp. at 2 n.2. Pyvo does not allege exhaustion or argue why it should be excused in this instance. The court will provide Pyvo seven days (until 10/16/27) to show cause why dispensing with exhaustion is appropriate here.(MZ) (Entered: 10/09/2026)

Judge Richard G. Stearns: ELECTRONIC ORDER entered. Given the allegation of changed circumstances, the court agrees that petitioner Roman Pyvo is entitled to a bond redetermination hearing. The government must arrange a bond hearing for Pyvo before an Immigration Judge (consistent with the standards outlined in Hernandez-Lara v. Lyons, 10 F.4th 19 (1st Cir. 2021)), as soon as practicable, but in no case later than Monday, October 26, 2026. The court directs the parties to report to the court within 48 hours of a decision from the Immigration Judge in this matter. (RGS, law3) (Entered: 10/19/2026)
