TEXT ORDER: The Court has reviewed the Petition for a Writ of Habeas Corpus filed pursuant to 28 U.S.C. § 2241 (ECF No. 1), and Respondents' October 29, 2026 letter (ECF No. 6). Respondents represent that Petitioner is subject to a final order of removal entered on November 20, 2017, and that the Board of Immigration Authorities denied Petitioner's appeal on April 19, 2019. Respondents further represent that ICE detained Petitioner on September 3, 2026, pursuant to 8 U.S.C. § 1231(a), and that Petitioner remains within the initial 90-day removal period, during which detention is mandatory under § 1231(a)(2). Under Zadvydas v. Davis, 533 U.S. 678, 701 (2001), detention pursuant to § 1231(a)(6) is presumptively reasonable for a period of six months following the expiration of the 90-day removal period. Here, Petitioner has been detained for approximately 56 days. Accordingly, any challenge to the reasonableness of his post-removal-period detention is premature. Petitioner has not demonstrated that his present detention violates federal law or the Constitution. Accordingly, it is ORDERED that the Petition for a Writ of Habeas Corpus (ECF No. 1) is DENIED WITHOUT PREJUDICE; and it is further ORDERED that the Clerk of Court shall CLOSE this matter. So Ordered by Judge Jamel K. Semper on 11/3/2026. (sms) (Entered: 11/03/2026)
