Stearns: ELECTRONIC ORDER entered re 11 Response to Petition for Writ of Habeas Corpus - 2241 filed by Markwayne Mullin, David Wesling, David Venturella, Todd Blanche, Daren Margolin, and Antone Moniz.Petitioner Tyron Bryce Cargin is a 27-year-old South African who came to the United States with his parents approximately ten years ago under his father's E-2 visa (because of threatened violence in their home country). Once here, Petitioner's father submitted an application for asylum, including Petitioner (derivatively), which has yet to be adjudicated. Petitioner has established a life here, working lawfully (currently valid through 2028) as a biotechnologist for a pharmaceutical company in Portsmouth, New Hampshire. Petitioner pays into social security and required taxes and has no criminal record. ICE arrested Petitioner and his father on September 11, 2026, at the airport in Manchester, New Hampshire, waiting to board a flight to visit Petitioner's sister in Baltimore, Maryland. Petitioner is currently held at the Plymouth County House of Correction. Pending adjudication of his asylum and immigration status, Petitioner is due a bond hearing. The court directs the government to arrange a bond hearing for him before an Immigration Judge (consistent with the standards outlined in Hernandez-Lara v. Lyons, 10 F.4th 19 (1st Cir. 2021)), as soon as practicable, but in no case later than Friday, October 2, 2026. The court directs the parties to report to the court within 48 hours of a decision from the Immigration Judge in this matter.(MZ) (Entered: 09/28/2026)
