TEXT ORDER - Before the Court is Petitioner's petition for writ of habeas corpus pursuant to 28 U.S.C. § 2241, ECF No. 1, and Petitioner's Motion for an Order to Show Cause. ECF No. 2. Respondents have filed a letter indicating that at the time the petition was filed--10:19 a.m. EDT on September 11, 2026--Petitioner was not confined in the District of New Jersey. ECF No. 5. According to the Declaration of James A. Laforge, an Assistant Field Office Director Deportation Officer, Petitioner arrived at Alexandria International Airport at 5:04 a.m. CDT on September 11, 2026 and was ultimately booked into the River Correctional Center in Ferriday, Louisiana. ECF No. 5-1. It is firmly established that this Court's habeas jurisdiction lies only in the district where petitioner is confined. Rumsfeld v. Padilla, 542 U.S. 426, 435 (2004). Indeed, the Third Circuit has consistently upheld that § 2241 petitions are properly filed in the district where petitioner is confined. See United States v. Sheppard, 742 Fed.Appx 599, 601 (3rd Cir. 2018); Meyers v. Martinez, 402 F. Appx 735, 735 (3d Cir. 2010); Jennings v. Holt, 326 Fed.Appx 628, 630 (3rd Cir. 2008). Here, it is clear from Respondents' filings that Petitioner was not confined in the District of New Jersey when the Petition was filed. See ECF No 5-1. Accordingly, jurisdiction in this District is improper. Padilla, 542 U.S. at 441. When a federal court lacks jurisdiction, it may transfer the case to another federal court that does have jurisdiction if it is in the interest of justice to do so. See 28 U.S.C. § 1631. This Court finds that transferring this case to the Western District of Louisiana is in the interest of justice. Petitioner has paid the filing fee and there is no indication that Petitioner was not proceeding in good faith when he filed the petition in this District, because Petitioner was transferred from the district mere hours before filing his Petition. Accordingly, the Court will TRANSFER the case to the Western District of Louisiana, without addressing the merits of Petitioner's claim or the merits of his Motion for an Order to Show Cause.
