The Court adopts the parties' proposed schedule as follows: Respondents' Response is due November 1, 2026, and Petitioner's Reply is due December 11, 2026. This matter is set for an evidentiary hearing and oral argument on the Petition on December 18, 2026, at 9:30 AM in Eugene Courtroom 1 before Judge Mustafa T. Kasubhai. Pursuant to Rule 6(a) of the Rules Governing Section 2254 Cases in the United States District Courts, and based upon the specific allegations before the Court, the Court finds good cause to authorize discovery under the Federal Rules of Civil Procedure. See Bracy v. Gramley, 520 U.S. 899, 909 (1997) (good cause exists for discovery in habeas cases "where specific allegations before the court show reason to believe that the petitioner may, if the facts are fully developed, be able to demonstrate that he is... entitled to relief") (citation omitted). Thus, the Court's order at ECF No. 8 does not preclude Petitioner from seeking discovery sooner than 12/11/2026, pursuant to properly served requests for production.
