(IN CHAMBERS) ORDER SETTING BRIEFING SCHEDULE AS TO EX PARTE EMERGENCY APPLICATION FOR TEMPORARY RESTRAINING ORDER (DKT. 2 ) (A No. 246-062-122) by Judge Michelle Williams Court. Having reviewed Petitioner Humberto Hernandez Sebastian's ("Petitioner") Ex Parte Application for Temporary Restraining Order (Dkt. # 2, "Application"), the Court ORDERS as follows: Petitioner (A No. 246-062-122) may not be removed from the Central District of California pending further order of the Court. Respondents are cautioned that sanctions may be imposed if Respondents take any action impairing Petitioners ability to obtain complete relief. Respondents shall file an opposition no later than Tuesday, September 15, 2026. Petitioner shall file a reply no later than Thursday, September 17, 2026. IN CHAMBERS-ORDER REFERRING CASE TO THE FEDERAL PUBLIC DEFENDER TO CONSIDER APPOINTMENT OF COUNSEL by Judge Michelle Williams Court. Here, the Weygandt factors sufficiently support the appointment of counsel to represent Petitioner. The office of the Federal Public Defender for the Central District of California ("FPD") has indicated that it will accept appointments to represent pro se petitioners in immigration-related habeas corpus proceedings such as this one. Accordingly, the Court REFERS this case to the FPD for consideration of appointment of counsel for Petitioner. The FPD is ORDERED to file a response within three days of this order issuing, indicating whether the FPD will represent Petitioner in this matter. This obligation shall be satisfied if the FPD files a notice of appearance in this case. The Clerk of Court is DIRECTED to serve a copy of this order on the FPD. IT IS SO ORDERED.
