Minute Order by Judge Jinsook Ohta: The Court adopts the Standard Procedures for Immigration Habeas Petitions from Chief Judge Order No. 144 with the following modifications: The government's return shall identify and address any individualized concerns regarding Petitioner's danger to the community or flight risk, including the factual basis for any such concerns. Petitioner's optional traverse shall be due within three days of the government's return. Further, the Court sets a hearing on the petition for October 1, 2026 at 9:30 AM. All parties may appear by videoconference for the hearing. The courtroom deputy will provide the videoconference information ahead of the hearing, which will proceed unless the Court issues a written decision on the merits ahead of the hearing date. Minute Order by Judge Jinsook Ohta: After examining Petitioner's habeas petition (Dkt. 1), the Court finds that representation is necessary given the complexity and potential merit of the constitutional, statutory, and procedural issues presented. See Weygandt v. Look, 718 F.2d 952, 954 (9th Cir. 1983). Accordingly, the Court GRANTS Petitioner's motion to appoint counsel [Dkt. 6] and CONDITIONALLY APPOINTS Federal Defenders of San Diego, Inc. as counsel for Petitioner, subject to Federal Defenders' review of the case and acceptance of the appointment. Federal Defenders shall review the case and determine whether to accept the appointment, considering Petitioner's financial eligibility for appointed counsel, Federal Defenders' available resources, and any other relevant circumstances. On or before October 2, 2026, Federal Defenders shall notify Petitioner and file a notice with the Court indicating whether it accepts or declines representation. If Federal Defenders accepts the appointment, the Court ORDERS Petitioner to file (1) an amended petition by October 9, 2026, and (2) a Form CJA 23 financial affidavit by October 23, 2026, demonstrating financial eligibility for appointed counsel. See Terrovona v. Kincheloe, 912 F.2d 1176, 118182 (9th Cir. 1990); 18 U.S.C. § 3006A(b). If Federal Defenders declines representation, Petitioner shall continue to proceed without counsel. In light of the Court's order that Petitioner file an amended petition, the Court DENIES as moot Petitioners motion for leave to file his traverse [Dkt. 5]. Signed by Judge Jinsook Ohta on 9/28/2026.
