TEXT ORDER. This matter comes before the Court upon Pro Se Petitioner's application to proceed in forma pauperis, Dkt. No. 1-1, ("IFP App.")and his petition for writ of habeas corpus under 28 U.S.C. 2241 alleging his immigration detention in Delaney Hall Detention Facility in Newark, New Jersey is unlawful, Dkt. No. 1, Petition. Respondents filed an answer to the petition, Dkt. No. 4, stating Petitioner was transferred from Delaney Hall Detention Center in Newark, New Jersey to Adams County Correctional Facility in Natchez, Mississippi on September 6, 2026; however, they do not contest this Court's jurisdiction. It is ORDERED that Petitioner's IFP application is DENIED without prejudice because it is incomplete because it reports that Petitioner has zero income and assets and zero expenses. Petitioner may cure this defect by resubmitting a properly completed IFP application under 28 U.S.C. 1915(a) or by submitting the $5 filing fee for a habeas petition to the Court within fourteen days of this Order. In addition to filing a completed application or paying the filing fee, the Petitioner shall also address Respondents' position that Petitioner entered a voluntary agreement of departure and whether such agreement contains a finding of removability or an alternate order of removal. The Clerk shall serve a copy of this order to Petitioner's email address on file. Respondents may transfer Petitioner back to New Jersey but shall not otherwise transfer or remove Petitioner from Mississippi during the pendency of this proceeding.
