TEXT ORDER: This matter is before the Court on pro se Petitioner's petition (Petition) for a writ of habeas corpus under 28 U.S.C. § 2241 (ECF No. 1 ), Petitioner's motion for a temporary restraining order(Motion for TRO) (ECF No. 2), and Respondents letter request to lift the transfer injunction (ECF No. 5 ). On August 28, 2026, the Honorable Robert Kirsch, U.S.D.J., denied Petitioner's prior counseled habeas petition (and lifted the stay) on the grounds that, because Petitioner has a final order of removal, he is subject to detention under 8 U.S.C. § 1231, and Petitioner's detention is not unreasonably prolonged under Zadvydas v. Davis, 533 U.S. 678 (2001). Liu v. Soto, No. 26-3331, 2026 WL 2546886, at *1-3 (D.N.J. Aug. 28, 2026). For substantially the same reasons stated by Judge Kirsch, the Court DENIES the pro se Petition (ECF No. 1). The Court additionally notes that Petitioner is scheduled to be removed from the United States on a flight out of John F. Kennedy International Airport tomorrow, September 9, 2026, Petitioner's travel document expires on September 18, 2026, and it is difficult to obtain renewed travel documents from the Chinese consulate. (ECF No. 5 at 1.) The Motion for TRO (ECF No. 2 ) is DENIED, and the Clerk of the Court shall TERMINATE the Motion pending at ECF No. 2 . The Court LIFTS the Order (ECF No. 3) enjoining Respondents from transferring Petitioner from New Jersey pending further Order of the Court. The Clerk of the Court shall CLOSE this matter.
