ORDER TO SHOW CAUSE: On August 29, 2026, a petition for a Writ of Habeas Corpus ("Petition") was filed pursuant to 28 U.S.C. § 2241. Dkt. No. 1. Petitioner also filed a motion for a temporary restraining order on August 31, 2026. Dkt. No. 2. Upon consideration of the Petition, IT IS HEREBY ORDERED that: 1.Respondents file and serve a sworn declaration stating Petitioner's location and the title of his immediate custodian and a full chronology of Petitioner's physical custody from his detention on August 28, 2026 to the present, by September 1, 2026. 2.Respondents show cause why the Petition should not be granted by September 3,2026. 3.Petitioner have an opportunity to reply by September 8, 2026. 4.The parties APPEAR before this Court for a hearing on the Petition on Thursday,September 10, 2026, at 9:00 a.m. in the courtroom of the assigned Judge. 5.Pending consideration of the Petition, Respondents are hereby RESTRAINED from transferring the Petitioner out of the Southern District of New York, the Eastern District of New York, or the District of New Jersey, and, relatedly, the United States of America. Respondents are further ORDERED to ensure that Petitioner has access to his counsel, and shall not impede Petitioner's religious exercise while detained, including his observance of the Sabbath, his access to kosher food, and his possession and use of articles of prayer. By September 1, 2026, Petitioner's counsel is directed (1) to serve Respondents with a copy of the Petition, along with a copy of this Order, by overnight mail or hand-delivery to the United States Attorney's Office for the Southern District of New York at 86 Chambers Street, New York, NY, and by electronic delivery to jeffrey.oestericher@usdoj.gov and brandon.waterman@usdoj.gov; and (2) to promptly file proof of such service on the docket. STIPULATION AND ORDER TRANSFERRING THIS ACTION TO THE DISTRICT OF NEW JERSEY: NOW, THEREFORE, IT IS HEREBY STIPULATED AND AGREED, by and between the undersigned counsel for the parties, subject to the approval of the Court, that: 1. This action shall be transferred in its entirety to the United States District Court for the District of New Jersey pursuant to 28 U.S.C. § 1406(a), or in the alternative 28 U.S.C. § 1404(a) or 28 U.S.C. § 1631, and shall not be dismissed. The action shall retain its original filing date of August 29, 2026 for all purposes. 2. The seven-day waiting period in Local Civil Rule 83.1 is waived, and this action shall be transferred forthwith and without delay. 3. Paragraph 5 of the Order-including the restraint on transferring Petitioner out of the Southern District of New York, the Eastern District of New York, or the District of New Jersey; the restraint on removing Petitioner from the United States; and the provisions concerning Petitioner's access to counsel and religious exercise, including his observance of the Sabbath, his access to kosher food, and his possession and use of articles of prayer - shall remain in full force and effect following transfer, unless and until modified by the transferee court. 4. Respondents shall promptly notify the Court and Petitioner's counsel within one business day of any change in Petitioner's place of detention. 5. Respondents waive any further objection to venue over this action in the District of New Jersey, and shall not move to dismiss or transfer this action on venue grounds in that court. 6. Petitioner may file an amended petition in the transferee court within seven (7) days of the action being docketed there, including to name Petitioner's immediate custodian as a respondent, and any such amendment shall relate back to the original August 29, 2026 filing date, as further set forth.
