District Judge Leo T. Sorokin: ELECTRONIC ORDER entered. The respondents have answered the petition by urging that the petitioner’s detention is lawful because he is the subject of a reinstated final order of removal. They have also conveyed ICE’s stated intention to remove the petitioner forthwith, with plans to transfer him out of Massachusetts in order to do so, having provided written notice to the Court as required by a prior Order in this case. Doc. No. 8. The petitioner has not disputed the existence of the removal order or suggested he cannot be lawfully detained pursuant to it. He has not sought leave to reply. Rather, he has objected to the notice of intent to transfer him outside of Massachusetts, urging the Court to prevent his transfer so that his lawyer may prepare and file in the immigration court a request to reopen his long-closed removal proceedings. Doc. No. 10. That is not the proper function of a federal habeas court. In these circumstances, the objection is overruled and the petition is DENIED.(SED) (Entered: 09/11/2026)
