Judge Allison D. Burroughs: ELECTRONIC ORDER entered. On September 22, 2026, Respondents requested that the Court’s order staying removal be vacated so that they can effectuate Petitioner’s removal to the Central African Republic (“CAR”) today, September 24, 2026. [ECF No. 17 ]. Based on the First Circuit’s recent ruling in D.V.D. v. U.S. Dep’t of Homeland Sec., No. 26-1212, 2026 WL 2797801 (1st Cir. Sep. 18, 2026), the facts set forth in Petitioner’s September 23, 2026, brief, including that Petitioner claims a fear of removal to the CAR and intends to move to reopen his immigration case, [ECF No. 19 ], and additional reasons set forth during today’s hearing, the Court is not persuaded that removal is sufficiently imminent to warrant dissolution of the stay. Accordingly, Respondents’ request that the Court’s stay of removal be lifted, [ECF No. 17 ], is DENIED. The stay of removal will remain in place until the issues raised in Petitioner’s petition are resolved by this Court. (CAM) (Entered: 09/24/2026)
