District Judge Margaret R. Guzman: ELECTRONIC ORDER entered. Following today's hearing on Petitioner's Emergency Motion for Temporary Restraining Order and Preliminary Injunction [ECF No. 2], the Court orders supplemental briefing on whether applying 8 U.S.C. § 1252(g) to Petitioners claims would violate the Suspension Clause. The parties shall address whether Devitri v. Cronen, 289 F. Supp. 3d 287 (D. Mass. 2018), and its jurisdictional companion, 290 F. Supp. 3d 86 (D. Mass. 2017), are instructive on the facts presented here. They shall do so in light of subsequent authority, including DHS v. Thuraissigiam, 591 U.S. 103 (2020), and Gicharu v. Carr, 983 F.3d 13 (1st Cir. 2020). Petitioner was asked to respond to the Respondents' position on this issue during the hearing and failed to do so fully and substantively. Now is the time. The parties shall file a supplemental memorandum, not to exceed 15 pages, by October 29, 2026. The Court does not require further briefing on the issue of "custody." To preserve the status quo while the Court determines its jurisdiction, the administrative stay [ECF No. 6] remains in effect pending further order. (SF) (Entered: 10/22/2026)
