DOCKET TEXT ORDER. Although Respondents have not yet been served in accordance with Federal Rule of Civil Procedure Rule 4(i)(1), counsel for the federal Respondents has entered an appearance in this action. Nevertheless, the Tenth Circuit has held that the United States cannot waive service of process. See Constien v. United States, 628 F.3d 1207, 1213 (10th Cir. 2010). Accordingly, the Clerks Office shall promptly prepare a summons for each Respondent and provide them to the United States Marshals Service for service. With respect to Respondents Todd Blanche, Markwayne Mullin, David Venturella, and Ruben Leyva, the United States Marshals Service shall promptly send a summons, as well as a copy of the petition, by certified or registered mail to (1) the civil-process clerk at the office of the United States Attorney for the District of Utah, (2) the Attorney General of the United States at Washington, D.C., and (3) each respondent or his successor in office, in accordance with Federal Rule of Civil Procedure 4(i)(1)(2). With respect to Respondent Ryan Arbon, the United States Marshals Service shall promptly serve him a summons, as well as a copy of the petition, by any method authorized under Federal Rule of Civil Procedure 4(e).
